OFFICIAL RULES
No purchase necessary to enter or
win. Void where prohibited. Many will enter. Few will win.
Parent’s permission must be obtained before entering.
1. How it Works: “The
Search for Flat Stanley’s Next BIG Adventure” Contest (the “Contest”)
begins 12:01 a.m. Eastern Time (“ET”) October 19, 2009 and ends 11:59
p.m. ET November 30, 2009 (“Contest Period”). Submit your story
and Flat Stanley for an opportunity to win a prize (see prize details
below).
2. Eligibility: Contest
is open only to legal residents of the fifty (50) United States and the
District of Columbia who are between the ages of 7 and 12, as of
October 19, 2009. YOU MUST OBTAIN YOUR PARENT’S OR LEGAL
GUARDIAN’S CONSENT BEFORE ENTERING. Children of employees of
Adventures by Disney Travel Services, Inc., HarperCollins Publishers,
Trust u/w/o Richard C. Brown, a/k/a Jeff Brown f/b/o Duncan Brown
(collectively, “Sponsors”), Trymark Consulting Group, L.L.C., and their
respective parents, affiliates, subsidiaries, advertising and promotion
agencies, retailers, distributors and suppliers, and the immediate
families (spouse, parents, children and siblings and their respective
spouses, regardless of where they reside) and individuals living in the
same households of any of the foregoing individuals, whether or not
related, are ineligible to participate or win a prize. Void where
prohibited by law. Subject to all applicable federal, state and
local laws and regulations.
3. How to enter: During
the Contest Period, log on to
www.flatstanleybooks.com/adventuresbydisney and follow the directions
provided to do each of the following:
(1) Download and print out your
destination entry pack, which will include an Entry Form, a Flat
Stanley, background, clothing and accessories.
(2) Color/embellish each piece and attach Flat Stanley and his
accessories to the background. Colors and embellishments may not be
photos, cut-outs from magazines or created digitally or using any
computer software. Flat Stanley should be colored/embellished using
arts and crafts materials, such as yarn, buttons, sand, markers,
crayons, glitter or paint.
(3) Write a story of one-hundred fifty (150) words or less about
Flat Stanley’s adventure in the destination chosen using information
provided on the web site and your own creativity.
(4) Have your parent or legal guardian complete and sign the
Entry Form.
(5) Mail Flat Stanley, story and Entry Form (collectively, the
“Entry”) in an envelope with proper postage affixed to: Trymark
Consulting Group, “The Search for Flat Stanley’s Next BIG Adventure”
Contest, P.O. Box 6394, Parsippany, NJ 07054.
Stories should focus on describing Flat Stanley’s adventure in the
selected continent or country destination. All writing portions
of Entries must be in the form of a story. Entries submitted in
other forms such as poems or songs will be void. All Entries must
be postmarked by November 30, 2009 and received by December 7, 2009 to
be considered. Stories will be accepted in English only.
Entries generated by mechanical means and entries by any means which
subvert the entry process are void. Limit one (1) Entry per child
for the entire Contest Period. If multiple Entries are received
from any child, only the first such Entry will be considered. All
Entries become the property of the Sponsors and will not be
returned. Except as otherwise provided herein, Sponsors will not
enter into any correspondence with an entrant regarding an Entry.
Entry Requirements:
Entry must be entrant’s own original work (excluding the Flat Stanley
template and information and materials provided on the Contest website
for use in the Contest) without assistance of any other individual and
may not contain profanities or obscenities nor depict Sponsors
unfavorably. Entry may not contain, as determined by the
Sponsors, in their sole discretion, any content that: (i) appears to
duplicate any other submitted Entries; (ii) defames, misrepresents or
contains disparaging remarks about other people or companies; (iii)
contains trademarks, logos, or trade dress owned by others (with the
exception of the Flat Stanley template and the information and
materials provided on the Contest website for use in the Contest); (iv)
contains any personal identification; (v) contains copyrighted
materials owned by others (with the exception of the Flat Stanley
template and the information and materials provided on the Contest
website for use in the Contest); (vi) features the image or likeness
any person or third party; or (vii) violates any law. Entries
must be consistent with the public images of Sponsors and must not
defame or invade publicity rights or privacy of any person, living or
deceased, or otherwise infringe upon any person’s personal or property
rights or any other third party rights, recognizing, however, that the
Entries may include the Flat Stanley template and information and
materials provided on the Contest website for use in the Contest.
Sponsors reserve the right in their sole discretion to disqualify any
Entry it determines does not comply with these requirements or these
Official Rules.
4. Judging: Entries will
be divided into three (3) age groups (7-8, 9-10 and 11-12) (each, an
“Age Group”). All eligible Entries received for each Age Group
will be judged by qualified judges from an independent judging
organization.
All eligible Entries received for each Age Group will be judged equally
on the following criteria (collectively, the “Judging Criteria”) to
select one (1) Grand Prize winner for each applicable Age Group:
1) Creativity
and imagination in representation of Stanley in submitted story (25%)
2) Inclusion of information/facts/activities
in story from destination selected (25%)
3) Overall creativity of clothing, accessories
and background selected in Flat Stanley picture (50%)
In the event of a tie for any Age Group, an additional, “tie-breaking”
judge will determine the winning Entry for the applicable Age Group
based on the Judging Criteria. Decisions of judges are final and
binding. Sponsors reserve the right to not award a prize for any
Age Group if, in their sole discretion, they determine they have not
received a sufficient number of qualified eligible Entries for that Age
Group.
Ownership/Use of Entries:
By entering, each entrant (and his/her parent or legal guardian)
warrant and represent that Entry is entrant’s own original work
(excluding the Flat Stanley template and information and materials
provided on the Contest website for use in the Contest), has not been
previously published, that entrant owns or otherwise controls all of
the rights to Entry (excluding any Sponsor owned trademarks and
materials) and that Entry does not violate any law, regulation or any
right of any third-party. By submitting an Entry, each entrant
(and his/her parent or legal guardian) unconditionally assign and
transfer to Sponsors all rights, title, interest and claim, which
he/she now has or may in the future have to the Entry or any element(s)
therein. Upon request, an entrant and/or an entrant’s parent or
legal guardian will execute and deliver to Sponsors such further
documents as Sponsors may reasonably request to evidence, confirm,
perfect and record Sponsors’ rights hereunder, including, without
limitation, documents relating to court approval. Each entrant
(and his/her parent or legal guardian) further acknowledge that the
Entry is derived from intellectual property owned by the Sponsors and
that the Sponsors have authorized the entrant to use such intellectual
property solely for the purpose of entering the Contest and expressly
prohibit its use for any other purpose. Sponsors and their
respective designees shall have the right to edit, reproduce, publish,
use, adapt, exploit, modify, distribute or dispose of any Entry,
online, in print, film, television, or in any other media now or
hereafter known throughout the world in perpetuity without
compensation, notification or approval of entrant (and his/her parent
or legal guardian) or any third party.
5. Prize Details: There are
three (3) Grand Prizes, one (1) per Age Group, consisting of one (1) of
the following nineteen (19) Adventures by Disney 2010 season Vacations
(choice is made by Grand Prize Winner):
• “Alpine
Magic” Vacation to Stresa, Zermatt and Lake Lucerne for 9 Days/8 Nights
(Approximate Retail Value (“ARV”) $17,216 - $23,416).
• Central Italy “Bella Italia” Vacation to
Sorrento and Florence for 8 Days/7 Nights (ARV $16,616 - $21,406).
• Hollywood “Backstage Magic” Vacation to
Hollywood and The Disneyland® Resort for 6 Days/5 Nights (ARV
$10,496 - $16,316).
• “Enchanted China” Vacation to Beijing,
Chengdu, Guilin, Shanghai and Hong Kong for 13 Days/12 Nights (ARV
$24,046 - $29,856).
• Australia “Discovery Down Under” Vacation to

to Fairbanks, Denali National Park & Reserve, Kenai Peninsula for 8
Days/7 Nights (ARV $16,466 - $20,266).
• Germany “Once Upon a Fairytale” Vacation to
Heidelberg, The Fairytale Route, Rothenburg and Munich for 9 Days/8
Nights (ARV $15,726 - $18,976).
• Italy “Viva Italia” Vacation to Rome,
Tuscany and Venice for 9 Days/8 Nights (ARV $17,686 - $22,016).
• Costa Rica “Path to Pura Vida” to San
José, Arenal, Quepos and Manuel Antonio National Park for 7
Days/6 Nights (ARV $16,646 - $20,216).
Each Grand Prize consists of a complete Adventures by Disney vacation
for winner and up to three (3) guests, as fully described at
www.adventuresbydisney.com (and incorporated herein by reference), as
well as roundtrip coach class air transportation from a major U.S.
gateway airport (or international gateway airport if required by trip
selection) nearest winner’s residence to the starting location of the
land package and from the final location of the land package back to
the airport or origin. No additional layovers, extensions or
modifications are included. Grand Prize winner and guest(s) must travel
together on the same tour and on the same dates. Details provided
on website for any trip are subject to change at Sponsors’ sole
discretion.
The land package includes: participation in the specified guided group
travel experience with a group of up to forty (40) individuals total;
services of two (2) Adventure Guides; local experts; on-tour luggage
handling; transportation within the land package; gratuities for
bellmen, housekeepers, drivers, activity providers and dining room
staff; scheduled meals; entertainment and activities (which vary by
land package); hotel accommodations in: (a) one (1) double occupancy
room for parties of two (2) or less; and (b) up to two (2) double
occupancy rooms for parties of three (3) or more depending on party
mix, availability and land package; and taxes associated with the
foregoing. See Adventures by Disney website www.adventuresbydisney.com
for details on the aforementioned, which vary by land package.
Not included in the Grand Prize are any and all taxes (including,
without limitation, state and federal income taxes) and the reporting
consequences thereof, associated with the use, acceptance, and
participation in the Grand Prize (except those stated above); luggage
handling between home and airport; meals, activities and ground
transportation not expressly included in land package; gratuities for
two (2) Adventures Guides; customs and immigration fees; passport and
visa costs; travel protection insurance; excess luggage fees; laundry
service; alcoholic beverages not expressly included in land or air
package; merchandise, souvenirs, etc; spa services and other optional
activities; local and long-distance telephone calls, additional taxes
may apply which are not included in the vacation package and any other
costs and expenses associated with prize acceptance and use not
specified herein as being provided.
General Prize Details:
Once Grand Prize winner has selected an Adventures by Disney Vacation,
it may not be changed. Actual value of each Grand Prize Package
may vary based upon location of departure city, destination location
and dates of travel. If winner chooses a less valuable Adventures
by Disney Vacation, he/she will not be compensated for the difference
in value between the chosen Adventures by Disney Vacation and the most
expensive Adventures by Disney Vacation listed. Travel must be
made through Sponsors’ agent, on a carrier of Sponsors' choice.
Each winner and his/her guest(s) must travel together on same
itinerary. If a winner resides within a 100-mile radius of
destination location, ground transportation will be provided in lieu of
air transportation and no compensation or substitution will be provided
for difference in prize value. Prize will be awarded to minor
winner’s parent or legal guardian who will be responsible for
fulfilling all requirements imposed on winners set forth herein and
such minor must accompany parent or legal guardian on trip as one of
his/her guests.
Each guest (or parent or legal guardian of minor guest) must execute
and return a travel release, liability release, and, except where
prohibited, a publicity release. Each guest (excluding the
winner) must be of legal age of majority in his/her state of residence
(and at least 18), unless accompanied by a parent or legal
guardian. All guests under age 18 at the time of travel must be
accompanied by a parent or legal guardian at all times. If a
potential winner is unable to travel on dates specified by Sponsors,
the applicable Grand Prize Package will be forfeited and Sponsors will
have no further obligation to such winner and time permitting, Sponsors
may award applicable Grand Prize Package to the next runner up for the
applicable Age Group(s) in its sole discretion. Each winner and
his/her guest(s) are responsible for obtaining all required travel
documents and taking any travel related precautions, including, without
limitation, passports, visas and inoculations prior to travel.
Travel dates are to be determined by Sponsors, certain blackout dates
and restrictions may apply. Travel must take place in the 2010
calendar year on dates specified by Sponsors. Sponsors reserve
right to change dates. Certain travel restrictions may
apply. Maximum ARV of all prizes: $94,308.00. Destinations
are subject to change without notice. Adventures by Disney
booking, cancellation policies and terms and conditions apply.
Itineraries and departure dates may be changed, cancelled or
discontinued at any time and without prior notice. Various
minimum age requirements and recommended ages, as well as size and age
requirements apply while on the selected trip, please see
www.AdventuresByDisney.com for any additional restrictions. All
travel is subject to change without notice. All prize details are
at the sole discretion of the Sponsors. Prizes are not
transferable, redeemable for cash, or substitutable except by Sponsors,
which reserve the right, at its discretion to substitute a prize, or
portion of prize, with one of comparable or greater value.
In addition to the Grand Prize Package, Sponsors reserve the right to
use the first name of any of the three (3) Grand Prize winners in a
future “Flat Stanley” book, but have no obligation to do so, without
payment of any additional consideration to such winner. In the
event the first name of any Grand Prize winner is used, Grand Prize
winner (and his/her parent or legal guardian) will be notified prior to
such use.
6. Notification:
Potential winners (and their parents or legal guardians) will be
notified by telephone, mail and/or e-mail and will have seven (7) days
from date of initial notification to respond to such
notification. The parent/legal guardian of each potential winner
will be required to execute and return an Affidavit of
Eligibility/Liability and, unless prohibited, a Publicity Release form
within fourteen (14) days of date of issuance. Fully-executed
documents should be returned via certified mail to: Trymark Consulting
Group, “The Search for Flat Stanley’s Next BIG Adventure” Contest, P.O.
Box 295, Gainesville, VA 20156. In the event of
noncompliance with these Official Rules, the inability to contact a
potential winner within the stated time period, the return of any
notification as undeliverable, the failure to respond to notification
within the specified time period or if required documents are not
executed and returned within the specified time period, prize may be
forfeited and at Sponsors’ discretion, awarded to the next runner up
for the Age Group at issue.
7. General Rules: This
Contest shall be governed by New York substantive and procedural law,
without giving effect to any choice of law or conflicts of laws rules
or provisions (whether of the State of New York or any other
jurisdiction), that would cause the application of the laws of any
jurisdiction other than the State of New York. By participating
in this Contest, entrants (and their parents or legal guardians)
irrevocably consent that New York courts shall have personal
jurisdiction over any dispute or litigation arising from or relating to
this Contest and that venue shall only be in the federal or state
courts of New York. By participating, entrants (and their parents
or legal guardians) agree as follows: a) to abide by these
Official Rules, and to the decisions of Sponsors and the judges, which
shall be final and binding in all respects; b) to the use of their
names and/or likenesses and/or biographical data by Sponsors and their
respective designees for advertising, promotional and other purposes in
any and all media now or hereafter known throughout the world in
perpetuity at discretion of Sponsors without compensation, permission
or notification (except where prohibited by law); and c) that Sponsors,
Trymark Consulting Group, L.L.C., and their respective parents,
affiliates, subsidiaries, advertising and promotion agencies,
retailers, distributors and suppliers, and each of their respective
officers, directors, shareholders, agents, and employees (collectively,
the “Released Parties”) shall have no liability and shall indemnify and
hold harmless the Released Parties from and against any damage, loss or
injury resulting, in whole or in part, directly or indirectly, from
participation in this Contest, violation of these Official Rules, the
use or misuse of any prize (including any travel/activity related
thereto) or Released Parties’ use of any rights granted herein.
Released Parties are not responsible for lost, interrupted or
unavailable network, server, cable, satellite, Internet Service
Provider (ISP) or other connections, miscommunications, failed phone,
computer or telephone transmissions or technical failure, jumbled,
scrambled or misdirected transmissions, or other problems or errors
related to participation in the Contest whether typographical,
printing, human, mechanical, computer, electronic or otherwise relating
to or in connection with the Contest, including, without limitation,
errors or problems which may occur in connection with the
administration of the Contest, the processing or judging of Entries,
the announcement of the prizes or in any Contest-related materials or
for any damage to entrant’s or other person’s computer hardware or
software as a result of participation. Released Parties are not
responsible for Entries or mail that are late, lost, stolen, damaged,
incomplete, inaccurate, undelivered, illegible, postage due,
misdirected, or delayed. Persons found tampering with or abusing
any aspect of this Contest or who are in violation of these Official
Rules as solely deter¬mined by the judges will be disqualified and
all associated Entries will be void. In the event the Contest is
compromised by virus, bugs, non-authorized human inter¬vention or
other causes which corrupt or impair the administration, security,
fairness or proper play of the Contest, Sponsors reserve the right in
its sole discretion to suspend or terminate the Contest (or any portion
thereof) and/or terminate the participation of any entrant (and void
his/her Entry) whose conduct potentially compromises the Contest and,
if terminated, at Sponsors’ discretion, judge all eligible, non-suspect
Entries received for the Age Categories at issue up to time of such
action using the judging procedure outlined above.
8. Winners’ List: The
names of the winners (available after December 30, 2009) and/or a copy
of these Official Rules may be obtained by mailing a self-addressed,
stamped (#10) envelope to: “The Search for Flat Stanley’s Next BIG
Adventure” Contest – Winners/Rules (please specify which), P.O. Box
295, Gainesville, VA 20156, for receipt no later than March 1,
2010.
